This Privacy Policy explains how Vortex UTV (“Vortex UTV,” “we,” “us,” or “our”) collects, uses, and shares personal information when you visit www.vortexutv.com (the “Site”), place an order, contact us, or otherwise interact with us (together, the “Services”). By using the Services you agree to the practices described here. If you do not agree, please do not use the Services.

Information we collect

Information you provide. When you place an order, create an account, join our email or SMS list, or contact us, we collect information such as your name, email address, phone number, billing and shipping address, order details, and the content of your messages. Payment card details are collected directly by our payment processor and are never stored on our systems.

Information collected automatically. When you use the Site we and our service providers collect usage data such as your IP address, browser and device type, pages viewed, referring pages, time on page, and interactions with the Site, using cookies, pixels, and similar technologies (see “Cookies and tracking” below).

Information from third parties. We may receive information from our commerce platform, payment and fraud-prevention providers, shipping carriers, and advertising or analytics partners, such as delivery status or aggregated campaign performance.

How we use information

To process and fulfil orders, arrange shipping, handle returns and warranty claims, and send order and shipping confirmations.
To provide customer support and respond to your requests.
To operate, secure, maintain, and improve the Site, including detecting and preventing fraud and abuse.
To send marketing communications by email or text message when you have opted in; you can unsubscribe at any time using the link in any email or by replying STOP to any text.
To measure and improve our marketing, including showing you ads on other sites based on your visit (see “Advertising and analytics”).
To comply with legal obligations and enforce our Terms.

Cookies and tracking

We use essential cookies to run the Site (cart, checkout, security), preference cookies to remember settings, and analytics and advertising cookies as described below. Most browsers let you refuse or delete cookies; if you block essential cookies, parts of the Site such as checkout may not work. We do not currently respond to browser “Do Not Track” signals, but we do honor Global Privacy Control signals where required by law.

Advertising and analytics

We use third-party services that may set their own cookies or pixels:

Google Analytics and Google Ads for site analytics, conversion measurement, and remarketing. You can opt out of personalized ads at adssettings.google.com and install the Google Analytics opt-out add-on.
Meta (Facebook and Instagram) pixel for ad measurement and remarketing. Manage your preferences at facebook.com/adpreferences.
Microsoft Advertising universal event tracking for conversion measurement. See the Microsoft Privacy Statement.

You can also opt out of interest-based advertising from participating companies at optout.aboutads.info.

How we share information

We do not sell your personal information for money. We share it only as needed to run our business:

Service providers acting on our behalf: our commerce platform (Shopify, which hosts checkout and order data), payment processors, fraud-prevention services, email and SMS providers, shipping carriers, hosting and content-delivery providers, and customer-support tools. They may use your information only to perform services for us.
Suppliers and fulfilment partners who ship products directly to you receive the name, address, phone number, and order contents needed to deliver your order.
Advertising and analytics partners as described above. Under some state laws this counts as “sharing” or “targeted advertising,” which you can opt out of as described in “Your privacy rights.”
Legal and safety: when required by law, subpoena, or legal process, or to protect the rights, property, or safety of Vortex UTV, our customers, or others.
Business transfers: in connection with a merger, acquisition, financing, or sale of assets, subject to this Policy.

Text message program

If you opt in to text messages, we will send order updates and, if you consent, marketing messages to the mobile number you provide. Message frequency varies; message and data rates may apply. Reply STOP to cancel or HELP for help. Consent is not a condition of purchase. Text-message opt-in data and consent are not shared with third parties for their own marketing.

Data retention

We keep personal information for as long as needed to fulfil the purposes above, including to maintain order and tax records, resolve disputes, and enforce our agreements, and then delete or anonymize it. Order records are retained as required by tax and accounting law.

Security

We use administrative, technical, and physical safeguards appropriate to the sensitivity of the information, including encrypted connections (HTTPS) across the Site and PCI-DSS-compliant payment processing. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.

Your privacy rights

Depending on where you live, you may have the right to: know what personal information we collect and how we use and share it; access a copy of your information; correct inaccurate information; delete your information; opt out of the sale or sharing of personal information and of targeted advertising; and not be discriminated against for exercising these rights. Residents of California, Colorado, Connecticut, Virginia, Texas, Oregon, and other states with comprehensive privacy laws may exercise these rights, and appeal a decision, by emailing [email protected] with the subject “Privacy Request” or calling (901) 412-9182. We will verify your identity (for example, by matching details of a recent order) before acting and will respond within the time required by law. You may designate an authorized agent to make a request on your behalf with written permission.

California notice. In the past 12 months we have collected identifiers, commercial information, internet activity, and geolocation inferred from IP address, for the purposes described above. We do not knowingly sell or share the personal information of consumers under 16. We do not use or disclose sensitive personal information other than as permitted by law.

Children

The Services are not directed to children under 13, and we do not knowingly collect personal information from anyone under 13. If you believe a child has provided us information, contact us and we will delete it.

International visitors

The Services are operated from the United States and intended for U.S. customers. If you access the Site from outside the United States, your information will be transferred to and processed in the United States.

Changes to this Policy

We may update this Policy from time to time. We will post the revised version here with a new effective date and, for material changes, notify you by email or a notice on the Site.
